B2B email is covered
The FTC explains that CAN-SPAM covers commercial email, including business-to-business messages. Use accurate sender information and subject lines, identify advertising appropriately and include a valid physical postal address.
Make opt-out work
Provide a clear way to stop future marketing. The FTC guide states that requests must be honored within 10 business days and that an opt-out mechanism must operate for at least 30 days after sending. Do not charge recipients to opt out.
Keep responsibility clear
Using a supplier or agency does not remove the sender’s responsibility. Check your sending platform’s policy and any additional privacy, state or channel-specific requirements. Purchasing a file does not itself establish consent.
